These Terms and Conditions ("Terms") govern your use of the PixelMint Studio website (pixelmintstudio.com) and any purchase of digital products from PixelMint Studio ("we," "us," or "our"), whether through our website, Etsy, Gumroad, or any other platform where our products are listed.

By accessing our website or purchasing our products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.

1. Definitions

• "Products" refers to all digital goods sold by PixelMint Studio, including but not limited to AI prompt libraries, Notion templates, digital planners, printable art, SVG files, creative assets, and any other digital downloads.
• "Customer," "You," or "Your" refers to any individual or entity that accesses our website or purchases our Products.
• "Platform" refers to any third-party marketplace through which our Products are sold, including Etsy, Gumroad, and others.
• "Content" refers to all text, images, graphics, code, templates, prompts, and other materials included in our Products.

2. Products and Digital Delivery

2.1 Nature of Products

All products sold by PixelMint Studio are digital goods. No physical items will be shipped. Products are delivered electronically via instant download links, Notion template duplication links, Google Sheets copy links, or other digital delivery methods as specified in the product listing.

2.2 Delivery

Upon completing your purchase, you will receive:

• An instant download link (via the Platform's standard delivery process), and/or
• A Notion template duplication link to copy the template to your own Notion workspace, and/or
• A Google Sheets "Make a Copy" link for spreadsheet-based products, and/or
• PDF, PNG, SVG, ZIP, or other file formats as specified in the product description.

2.3 Product Accuracy

We make every effort to accurately describe our Products including their contents, features, and specifications. Product preview images, descriptions, and mockups are for illustrative purposes. Minor variations in formatting, colors, or layout may occur depending on your device, software, or display settings.

2.4 Product Updates

Some Products (e.g., the Mega Prompt Library) may include free lifetime updates. Where stated, updates will be delivered through the original delivery method. We reserve the right to modify, discontinue, or limit update frequency at any time.

3. Pricing and Payment

3.1 Prices

All prices are listed in US Dollars (USD) unless otherwise stated. Prices are subject to change at any time without prior notice. The price at the time of purchase will be honored.

3.2 Taxes

Prices may not include applicable sales tax, VAT, or other taxes. Any applicable taxes will be calculated and displayed by the Platform at checkout. You are responsible for any and all taxes associated with your purchase.

3.3 Payment Processing

All payments are processed through the respective Platform (Etsy, Gumroad, etc.). We do not directly collect, store, or process payment card information. Payment is governed by the Platform's own terms and payment policies.

3.4 Promotional Pricing

We may offer discounts, coupon codes, bundle deals, or promotional pricing from time to time. Promotional prices are valid only during the specified period and cannot be applied retroactively to previous purchases. We reserve the right to modify or cancel promotions at any time.

4. Refund and Returns Policy

Because digital products can be instantly accessed, downloaded, and duplicated upon purchase, we are unable to verify whether a product has been used, copied, or retained after a refund request. For this reason:

• All sales of digital products are non-refundable.
• No exchanges or credits will be issued for purchased products.
• Duplicate purchases will not be refunded — please check your purchase history before buying.

4.1 Exceptions

In rare cases, we may consider a resolution at our sole discretion if:

• You received a corrupted or unreadable file and we are unable to provide a working replacement.
• The product was materially different from the description on the listing page.
• A technical issue on our end prevented you from accessing the product entirely.

In such cases, please contact us at hello@pixelmintstudio.com within 7 days of purchase with your order details and a description of the issue.

5. License and Usage Rights

5.1 Personal Use License

Unless otherwise stated in the product listing, purchasing a Product grants you a non-exclusive, non-transferable, personal use license to:

• Download and use the Product for your own personal or professional purposes.
• Use AI prompts and their generated outputs for personal or commercial projects.
• Print printable products for personal use or personal gifting.
• Modify templates and planners for your own use.

5.2 Restrictions

You may NOT:

• Resell, redistribute, sublicense, or share the Product files (in whole or in part) with any third party, whether for free or for a fee.
• Upload the Product files to any file-sharing platform, torrent site, or public repository.
• Claim authorship or ownership of the Product or its underlying content.
• Use the Product to create derivative products intended for resale that are substantially similar to the original.
• Transfer your license to another individual or entity.
• Use the Product in any way that competes directly with PixelMint Studio.

5.3 Commercial Use

Where a product listing explicitly states "Commercial Use Allowed" or "Commercial License Included," you may use the Product and its outputs in commercial projects (e.g., client work, business materials, published content). This does not grant the right to resell or redistribute the Product itself.

5.4 AI Prompt Output

For AI prompt products, the prompts themselves are our intellectual property. However, the outputs generated by AI toolswhen you use our prompts belong to you, subject to the terms of service of the AI platform you use (e.g., OpenAI's usage terms for ChatGPT outputs).

6. Intellectual Property

All Products, website content, branding, logos, designs, text, graphics, and code created by PixelMint Studio are protected by copyright, trademark, and other intellectual property laws. Purchasing a Product does not transfer ownership of any intellectual property rights.

The PixelMint Studio name, logo, tagline ("Fresh digital assets, endlessly scalable"), and brand identity are trademarks of PixelMint Studio and may not be used without our written permission.

7. User Conduct

By using our website and purchasing our Products, you agree to:

• Provide accurate and complete information when making purchases or contacting us.
• Use our Products in compliance with all applicable laws and regulations.
• Not engage in any activity that disrupts or interferes with our website, services, or other customers' experience.
• Not attempt to gain unauthorized access to our systems, accounts, or data.
• Not use automated tools (bots, scrapers, etc.) to access our website without our written permission.

8. Third-Party Platforms and Services

Our Products may be sold on or integrate with third-party platforms including but not limited to Etsy, Gumroad, Notion, Google Workspace, Canva, and various social media platforms. Your use of these platforms is governed by their respective terms of service and privacy policies. We are not responsible for the practices, policies, or actions of any third-party platform.

9. Disclaimer of Warranties

Our Products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• Our Products will meet your specific requirements or expectations.
• AI prompts will generate specific results, as AI output varies based on the AI tool, model version, settings, and context.
• Our website will be uninterrupted, secure, or error-free.
• Any defects in the Products will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, PixelMint Studio and its owners, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, revenue, business opportunities, or goodwill, arising out of or related to:

• Your purchase or use of our Products.
• Your inability to access or use our Products.
• Any errors, inaccuracies, or omissions in our Products.
• Any unauthorized access to or alteration of your data.
• Any AI-generated output resulting from the use of our prompt products.

In no event shall our total liability exceed the amount you paid for the specific Product giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless PixelMint Studio, its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of our Products, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14. Entire Agreement

These Terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and PixelMint Studio regarding your use of our website and purchase of our Products, superseding any prior agreements or understandings.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the revised Terms on our website with an updated "Last updated" date. Your continued use of our website or Products after any changes constitutes your acceptance of the revised Terms. Material changes will be communicated through prominent notice on our website.
